User Agreement
General
1. This user agreement ("agreement") is a contract between you and the providers of GigThing.com. By using the services of GigThing.com, you confirm that you have read, agreed and accepted all of the terms and conditions contained in this agreement. Anyone not restricted by local laws may use the services of GigThing.com but to be eligible to start your own calendar, you must be at least 18 years old.
2. We may amend this agreement at any time by posting a revised version on our website. The revised version will be effective at the time we post it. In addition, if the revised version includes a substantial change, we will provide you with 30 Days' prior notice of substantial change via your registered e-mail address. "Substantial change" means a change in pricing of our services or to the terms of this agreement that reduces your rights or increases your responsibilities. We last modified this agreement on February 15, 2008.
3. You may not transfer or assign any rights or obligations you have under this agreement without our written consent. We reserves the right to transfer or assign this agreement or any right or obligation under this agreement at any time.
4. You agree that we may provide notice to you by posting it on GigThing.com and e-mailing it to your e-mail address. Such notice shall be considered to be received by you within 24 hours of the time it is posted to our website or e-mailed to you unless we receive notice that the e-mail can not delivered.
Pricing and payments
5. Starting an account at GigThing.com is free and so are Basic Calendars.
6. The price for maintaining a Pro Calendar is $9 / month per calendar. For residents within the EU, 25% VAT is added to the total sum.
7. The price of the calendars you maintain is billed monthly in advance to your credit card as a recurring payment. At any time, you can stop the upcoming payment by downgrading your calendars to Basic Calendars.
Your Privacy and safety
8. Protecting your privacy is very important to us. Therefore, we never share your personal information to third parties.
9. When you visit GigThing.com we collect your IP address and standard web log information, such as your browser type and the pages you accessed on our website. If you open an account, we collect your name, e-mail address, user name, password and similar information. If you start a calendar, we will collect your billing address and credit card information. Your billing address and credit card information is used by us or a third party to execute payments. When you use our service, we collect information about your account activity to track errors and for fraud prevention purposes. We may also collect additional information from or about you in other ways not specifically described here. For example, we may collect information related to your contact with our customer support or store results when you respond to a survey.
10. When you access GigThing.com, we may place small data files called "cookies" on your computer. This type of cookie helps us to recognize you if you visit multiple pages on our site during the same session, so that we don’t need to ask you for your password on each page. We encode our cookies so that only we can interpret the information stored in them. You are free to decline our cookies if your browser permits, but doing so may interfere with your use of GigThing.com.
11. With the help of third party suppliers, we store and process your personal information and data using computer safeguards such as firewalls and data encryption. All data is regularly backed-up to minimize the damage in case of a data storage breakdown.
Liability and dispute
12. In case of an interruption of our services that extends for over 24 hours, you are eligible for a discount. The discount is equivalent to the fee you would normally pay for that period of time and only applies for active calendars that you maintain and pay for. Above this, no liability claims can be made concerning interruptions, data loss or any other cause.
13. If a legal dispute or liability claim arises between you and the providers of GigThing.com, the dispute will be solved in accordance with Swedish regulations and law in a Swedish court of law.
